SUBJECT: THEFT OF SMALL PLANE ACTIVATES SHOOTDOWN PROCEDURES

REF: A. 08 BRASILIA 1170 B. IIR 6 809 0120 09 C. 08 BRASILIA 1214 Classified By: DCM Lisa Kubiske. Reason 1.4 (d)

1. (S/NF) Ref B describes a March 12 incident in which a small private aircraft was stolen at gunpoint in Luziania (approximately 23 miles from Brasilia) and after two hours was intentionally crashed into a parking lot of a shopping mall in Goiania, approximately 90 miles from Brasilia. The incident was notable in that it provoked a rare activation of Brazil's shootdown procedures (described in ref a). Given the plane's proximity to the federal capital and lack of any flight plan, Brasilia Air Traffic Control notified Air Defense Control, which scrambled planes from Anapolis Air Base to intercept, observe and try to communicate (details in ref b). When the plane suddenly steered for a densely populated area and a large shopping mall, controllers began to view it as a threat. With the possibility that the stolen plane could be used as a weapon, Air Defense Command briefed Air Force Chief Brigadeiro Junito Saito. Saito then contacted Defense Minister Jobim and President Lula about the possibility of ordering a shootdown should there be a threat to civilians. During the discussion, the pilot went down in the mall parking lot.

2. (C) COMMENT: The Brazilian Air Force followed exactly the procedures provided to Embassy Brasilia last year in going up the chain of command before authorizing a shootdown. Because of the seriousness of a potential threat to a large number of citizens in the mall, the Air Force took the additional step of consulting with the President. While no decision was made before the plane crashed, the procedure followed illustrates the extreme caution with which a possible shootdown is approached, the broad understanding of the shootdown policy among air traffic controllers and the fact that the procedures are executed as written. Mission believes that the March 12 incident provides an illustration of the effectiveness of Brazil's procedures to prevent inadvertent shootdowns that were the basis of the recommendation for Presidential certification of Brazil in ref c. The fact that the procedures were correctly followed on March 12 demonstrates that they remain well known to pilots, controllers and decision makers. Along with the absence of any indication that conditions have changed with regard to shootdowns, this incident provides a strong case for recertification later this year.

3. (S/NF) COMMENT, CONTINUED: On the other side of the coin, the deliberate approach to a shootdown decision highlighted a vulnerability to potential terrorist actions given that a decision would not have been made in time to stop the pilot had he been able to crash into his target or another building, including in Brasilia. In part, this vulnerability stems from Brazil's shootdown procedures having been developed to apply to drug smuggling aircraft in Brazil's vast northern areas, not to potential attacks on cities. Based on DAO discussion with the Brazilian Air Force and Air Traffic control, the Brazilians consider their shootdown procedures to be effective but may look at ways to accelerate decision making during a potential terrorist attack.

1. (U) On May 20, PolOff delivered reftel and talking points to Brazil's Ministry of External Relations (MRE) International Organizations Division (DOI) and the Human Rights Divisions (DDH). PolOff also delivered reftel talking points to UNHCR representative in Brasilia Luis Varese. PolOff's requests for a meeting with the Brazilian National Committee for Refugees (CONARE) were refused because CONARE's position has not changed since reftels A through D.

2. (C) Officials from DDH, DOI, and UNHCR confirmed that the GOB's position regarding this issue has not changed since 2003 and will likely not change in the foreseeable future. The GOB still contends that it cannot accept Guantanamo migrants because it is illegal to designate someone not on Brazilian soil a refugee. Despite multiple requests, PolOff did not receive a response regarding the USG's offer to pay for transportation for GOB resettlement officials to travel to Guantanamo. (Comment: Based upon Brazilian legislation and CONARE's strong stance against the USG's proposal, PolOff does not believe that the GOB will accept this arrangement. End Comment)

3. (C) DDH Office Director Marcia Ramos told PolOff that the GOB's close relationship with the Cuban government would make it impossible for the GOB to accept Cuban refugees. When PolOff asked if the GOB would consider accepting Haitian migrants only, Ramos said that due to Brazilian legislation, the GOB could not accept any migrants from Guantanamo Bay.

4. (C) UNHCR representative Luis Varese was more forthcoming in providing concrete answers to explain the GOB's position. (Note: Varese is a CONARE member and has one vote on the board. End note.) Varese told PolOff that refugee status in Brazil is usually granted after the refugee has been recognized by the host country (in this case, the U.S.). According to Varese, the GOB and CONARE believe that the migrants at Guantanamo Bay do not fit into this category because the USG has not "formally recognized" them as refugees. If they were formally recognized, CONARE believes, the USG would allow them to resettle in the U.S. so resettlement would not be an issue. Varese told PolOff that the "formal recognition" issue caused the GOB to reject the USG's proposal in 2003. He also told PolOff that CONARE's position would "probably not change" in the future.

Comment -------

5. (C) All attempts to discuss this issue with GOB and CONARE officials were flatly refused or accepted begrudgingly. In addition, this issue has been raised on numerous occasions and at a variety of levels, including U/S Grossman, since 2003. Given Brazilian legislation and Varese's comments, it does not appear that CONARE or the GOB will change their position on this issue. DANILOVICH

1. On October 16, Poloff delivered reftel demarche and left nonpapers in English and Portuguese with Gilda Mattos Santos Neves, head of the United Nations Division of the Ministry of External Relations (MRE), who promised to shepherd our request through the GOB. Neves said she would check with the National Committee for Refugees (CONARE), under the Ministry of Justice but with MRE representation, which she believed would have the lead. She was concerned, however, that the migrants did not fall neatly into any Brazilian legal category and were not being handled with the intermediation of the UNHCR. Poloff stressed UNHCR support for the resettlement program and the active involvement of IOM.

2. Neves did not raise any political or diplomatic issues with regard to resettling Cubans in Brazil, and she said she would report back to us after she received the views of CONARE and others in the GOB.

3. On October 28, Poloff revisited Neves to check on progress with regard to the Cuban migrants. Neves apparently had not received a positive reaction within the GOB and had nothing to report. Based on previous efforts to engage the GOB on this issue (ref B), we do not expect a definitive response. Nonetheless, we will check back periodically. KUBISKE
